Tại sao phải cần Jury ?
cho tốn thời gian, tốn tiền khi ông/bà toà có quyền quyêt định rồi ?

Alabama plans to execute on Thursday an inmate whose jury’s 11-1 vote for a life sentence was overridden by the trial judge who opted instead for the death penalty, a practice the state has since repealed.
Kenneth Smith, convicted of capital murder for his role in the 1988 killing of Elizabeth Sennett, should not be executed, his attorneys argued in a filing before the US Supreme Court. If he was tried today and his jury came to the same conclusion, they said, Smith would not be qualified for execution – not in Alabama or anywhere else, because no jurisdiction today allows the practice of judicial override.
Putting Smith to death despite the jury’s verdict, they say, would constitute cruel and unusual punishment, violating his constitutional protection under the Eighth Amendment.
Smith is one of four death row inmates set to be executed this week after the Supreme Court on Wednesday denied his request for a stay of execution. Stephen Barbee in Texas and Murray Hooper in Arizona were both executed Wednesday, and Richard Fairchild in Oklahoma was executed Thursday.
Smith’s slated execution comes as juries’ sentencing recommendations in death penalty cases are in the national spotlight. A jury failed to issue a unanimous recommendation in the sentencing trial of the Parkland school shooter, resulting in a life sentence.

người này nhận 3K nhưng không ra tay giết, đi kiếm ra 2 thằng bạn học chia cho 1 thằng 1k, còn 1k he giữ ..
số tiền 3K đó là ông chồng mượn của bà bồ trả cho người thủ tiêu bà vợ
kết luận 5 người involved trong chuyện này, rốt cuộc 3 ngu+ời chết, 1 người bị án tù chung thân, 1 người bác 8 đang nói trên giờ sắp đi xử tử

In 1988 - The key word is Judicial Override .. Meaning that there was no unanimous vote from the jury pool of 12, then the judge can have the discretion to impose the penalty. This is the penalty phase where unanimous vote is also needed.
Today, the Judicial Override does not afford the Judge to impose the penalty different from the majority of jurors from a jury pool had recommended.
