Bayer is facing more than 13,000 claims in US courts. All are linked to Roundup and Ranger Pro, two glyphosate-based weed killers that the German group acquired as part of its takeover of Monsanto Reuters


Bayer shares hit the lowest in almost seven years on Tuesday, after a California court ordered the German group to pay more than $2bn in damages to a pair of cancer patients — the biggest setback yet in its escalating US legal battle over glyphosate.

The sum was awarded to Alva and Alberta Pilliod, an elderly couple who claimed that their non-Hodgkin’s lymphoma was caused by exposure to Roundup, a glyphosate-based weedkiller made by Monsanto. 

Bayer acquired the US seeds and crop protection company last year in a $63bn takeover that has already cost the aspirin-to-chemicals group dearly.

Bayer stock fell 6 per cent when markets opened on Tuesday, leaving it lower than it had been at any time in the last seven years. The shares recovered some of the declines during the day to close down 2 per cent.

“Near-term sentiment is terrible,” analysts at Citi said.

The ruling — issued by a jury in Oakland, California — is the third courtroom defeat in a row for Bayer, but the damages involved in the Pilliod case dwarf the sums awarded to plaintiffs in the two previous trials. The verdict is certain to increase the pressure on Bayer management, which is under fire from shareholders angry about the recent legal setbacks and the resulting collapse in the group’s share price.

Bayer said in a statement that it was “disappointed with the jury’s decision” and promised to appeal against the verdict. “The consensus among leading health regulators worldwide [is] that glyphosate-based products can be used safely and that glyphosate is not carcinogenic,” the group said.

Bayer added: “We have great sympathy for Mr and Mrs Pilliod, but the evidence in this case was clear that both have long histories of illnesses known to be substantial risk factors for non-Hodgkin’s lymphoma . . . and there is not reliable scientific evidence to conclude that glyphosate-based herbicides were the ‘but for’ cause of their illnesses as the jury was required to find in this case.”

A California jury ruled last August that glyphosate-based weedkillers were directly responsible for the plaintiff’s terminal cancer, and ordered Bayer to pay $289m in damages. The sum was later reduced, but the verdict sparked a flood of similar claims that has alarmed investors and analysts. Bayer lost a second case in March, when another California jury ordered the group to pay damages of $80m to a cancer patient who had been exposed to glyphosate. 

Bayer faces more than 13,000 similar claims in US courts. All are linked to Roundup and Ranger Pro, two glyphosate-based weedkillers that the German group acquired as part of its takeover of Monsanto last year.

The group’s escalating legal woes have taken a heavy toll on the share price, which is down more than 40 per cent since the initial ruling. They have also dealt a blow to Werner Baumann, the Bayer chief executive and architect of the Monsanto deal. At last month’s annual shareholder meeting, investors took the unprecedented step of backing a no-confidence motion against the management board — highlighting the depth of anger.


Bayer insists that Roundup and Ranger Pro are safe. The German group points out that regulators around the world have approved the substance for use, backed up by scientific studies going back four decades. Bayer has appealed both earlier rulings, and says it is confident that the jury verdicts issued so far will ultimately be overturned.

One sign of the group’s confidence is that it has yet to make any financial provisions for glyphosate damages, though it has set aside money to cover the actual legal costs.

Monday’s jury award was the highest in the US this year and the eighth-largest in a product-defect claim, according to Bloomberg data.
