San Jose moves forward with mandatory face coverings
San Jose leaders on Tuesday unanimously approved moving forward with a mandatory face covering requirement, despite concerns from San Jose law enforcement that it would criminalize residents.
The proposal, authored by Vice Mayor Chappie Jones and Councilmember Sergio Jimenez, would require most people to wear a mask every time they step outside. The new directive comes one day after Santa Clara County public health leaders loosened local health orders to allow certain retailers to reopen for curbside pick-up.
The county’s new order mandates face coverings inside all businesses, a notable change from previous orders that merely encouraged wearing masks.
“It is clearly the best practice throughout the world in dealing with this virus,” Mayor Sam Liccardo, who supported the initiative, said. “(Masks) do not serve primarily to protect the mask wearers — they protect everyone else and that is a critical public health directive right now.”
The mandate would exempt masks for people exercising, children 6 years old or younger, or anyone who is otherwise unable to wear a face covering without assistance, as well as those advised by medical professionals not to wear one.
While many lawmakers said masks are an important step to curbing the spread of the virus, some said enforcing the new directive would create an additional hurdle for the city’s police department.
Councilmember Johnny Khamis expressed concern about enforcing the new mandate and said he can’t support a proposal that would “criminalize” people who aren’t wearing masks when walking their dog or picking up a newspaper.
“If I’m on my sidewalk, I don’t feel like I should be in violation of the law,” he said.
But Jones said five counties in the Bay Area have already implemented similar mandates and that the idea is “not radical,” but a necessary safety measure to save lives. San Francisco, Contra Costa, Alameda, Marin, San Mateo and Sonoma counties have issued required face mask mandates, as well as the cities of Palo Alto, Cupertino and Milpitas.
“What we are proposing is not radical, it is not infringing on people’s constitutional rights,” Jones said. “If we don’t have these types of safety measures as we open up the economy, then we’re going to have a spike in cases — we’re going to have more deaths.”
Still, San Jose police officials said they’re worried enforcing the mandate would “drive a wedge” between law enforcement and certain communities.
“We’re continuing to drive a wedge between us and the community by having officers asked to enforce these health orders,” San Jose Police Chief Eddie Garcia said. “This is not a good idea to continue to criminalize otherwise law-abiding residents for not wearing a mask.”
While the city won’t enforce the measure by issuing citations or penalizing residents, Liccardo said the move would establish “norms of behavior” to keep people safe as they go back to work.
“It is important to establish norms of behavior and laws do serve to establish those norms even if they are not perfectly enforced or enforced to the maximum,” Liccardo said, who added it was an important step to getting people back to work.
“That is my most important priority — getting people safely back to work so they can earn a paycheck, because we’ve got thousands of families struggling on the edge right now,” he added.
While some people may not “follow the rules,” Jones said, he believes many residents who “want to do the right thing” will abide by the mandate.
“I don’t have an expectation that every single person is going to follow the rules,” he said. “The expectation is that people who are honest and want to do the right thing are going to do the right thing.”
City officials will draft an ordinance and return to the City Council June 2 to discuss implementing the measure and aligning it with the county’s revised health order. It’s unclear when the new rules will go into effect.

Perhaps they can give 2 warnings b4 giving out fines. Are the fines going to be written through their driver's licenses otherwise how are they tracking who owes what?

Tui thấy nếu họ chỉ đứng trước sân nhà hay sidewalks của họ thì 0 nên bắt họ phải đeo masks bởi vì most of the times there are nobody else nearby thêre.
Nhưng nếu họ ở trong apartment chạy ra hallway giặt đồ hay lấy thơ thì cần phải đeo mask....but it's hard to enforce since normally there are no polices standing in the apartment hallway.
Mấy thằng polices cũng khó xử vì sẽ bị dân ghét thêm chưa kể gặp mấy thằng khùng nó bắn nếu làm khó nó nửa. Bây giờ làm việc nhà banks hay convenience/liquour stores cũng hơi sợ vì ai vào cũng đeo masks hết 0 biết ai sẽ cướp nửa.

Two more arrested in connection with shooting death of Family Dollar security guard
Two men charged in connection with the shooting death of a Michigan Family Dollar security guard who told a customer to put on a face mask have been arrested, officials said Friday.
Larry Teague, 44, was arrested Thursday by authorities in Houston and Ramonyea Bishop, 23, was arrested Friday afternoon in Bay City, Michigan, Genesee County Prosecutor David Leyton said.
The two were previously charged with first-degree premeditated murder, felony firearm and other charges but remained at large.
Authorities on Thursday arrested and charged Brya Bishop, 24, a fourth suspect in the case.
She has been charged with tampering with evidence, lying to police investigating a violent crime and being an accessory after the fact to a felon, according to a statement from the Genesee County Prosecuting Attorney's Office.
Brya Bishop's mother Sharmel Teague, 45, and brother Ramonyea Bishop, and her stepfather, Larry Teague, were charged earlier this week in last Friday's shooting death of security guard Calvin Munerlyn at the store in Flint.
After Munerlyn told Brya Bishop she needed a mask, he got into a verbal altercation with Sharmel Teague, according to the prosecutor's office. Surveillance video confirms the incident, Leyton said earlier this week.
Brya Bishop left the store, but "Teague began yelling at Munerlyn who then told her to leave the store and instructed a cashier not to serve her," the prosecutor's office said this week.
Under an executive order from Gov. Gretchen Whitmer, all retail employees and customers have to wear a mask.
Footage shows that immediately after the altercation, Teague left in an SUV, but about 20 minutes later, the SUV returned.
Two men -- identified as Ramonyea Bishop and Teague -- entered the store, according to a statement Monday from the prosecutor's office. One of them yelled at Munerlyn about disrespecting his wife, Leyton said. The other man, later identified as Ramonyea Bishop, then allegedly shot the security guard, the statement said.
Leyton said Thursday that Brya Bishop attempted to help her stepfather and brother after the shooting.
"Brya Bishop's attempts to shield family members will not be tolerated and we will likewise hold anyone else involved in offering shelter and assistance to Larry Teague or Ramonyea Bishop accountable under the law," Leyton said.
Brya Bishop is in custody at the Genesee County Jail. According to Deputy Chief Assistant Prosecutor John Potbury, she won't have a lawyer until her arraignment, which was scheduled for Friday morning.

chính quyền cũng phải ra luật này luật kia, cũng phải ra thông báo này kia thì dân khó thưa kiện khi nạn dịch tăng cao .
còn enforcement thì chưa chắc đủ người để làm .
thực ra khi mở cửa tự do ... một thời gian số người nhiễm bệnh và chết nhiều ... lúc đó khỏi cần bắt buộc, dân họ cũng tự ở nhà, ra đường cũng tự đeo mask

mấy cu San Jose' như Sam Licardo làm trò hề bày trò ra luật bắt đeo mặt nạ này nọ .. Chớ nó có dám kêu cảnh sát của nó tới cái khu "nhà thùng" cho anh em vô gia cư của nó mà phạt đám này không đeo mặt nạ không ?
